Welcome to Peakora (“we,” “our,” “us,” or the “Agency”). By accessing our website (www.peakora.in) or engaging our digital marketing, web development, and patient acquisition services, you (“Client,” “you,” or “your”) agree to be bound by the following Terms and Conditions.

Please read these terms carefully. If you do not agree with any part of these terms, you must not use our website or services.

1. Scope of Services

Peakora is a specialized B2B digital growth agency serving medical professionals, independent clinics, and multi-specialty hospitals. Our services include, but are not limited to:

  • Healthcare Web Design & Development
  • Local SEO & Google Business Profile (GBP) Optimization
  • Search Engine Optimization (SEO) & Medical Content Strategy
  • Paid Advertising (Google Ads, Meta Ads)
  • Social Media Branding & Patient Reputation Management

The specific scope of work, deliverables, and timelines will be outlined in a separate customized proposal or Service Level Agreement (SLA) provided to you prior to the commencement of any project.

2. Client Responsibilities & Medical Compliance

As a healthcare provider, you acknowledge that marketing in the medical field requires strict adherence to ethical guidelines and regulations.

  • Accuracy of Information: You are solely responsible for ensuring that all medical facts, procedural descriptions, and claims provided to us for marketing purposes are medically accurate.
  • Regulatory Compliance: You agree to ensure that all marketing campaigns, website content, and advertisements comply with the guidelines set forth by the National Medical Commission (NMC), the Indian Medical Association (IMA), or the relevant regulatory bodies in your jurisdiction.
  • No False Claims: Peakora prohibits the use of language that guarantees a “100% cure” or makes unethical medical promises. We reserve the right to refuse to publish content that violates medical advertising ethics.
  • Approvals: You agree to review and approve all medical content, ad copies, and graphics in a timely manner. Delays in approval may affect campaign performance and project timelines.

3. Medical Disclaimer & Liability

Peakora provides marketing and technology services. We do not provide medical advice, diagnosis, or treatment.

  • We are not liable for any medical malpractice, clinical outcomes, or disputes between you and the patients acquired through our marketing campaigns.
  • You agree to indemnify and hold Peakora harmless from any claims, lawsuits, or regulatory fines arising from the medical services you provide or the clinical claims made in your approved marketing materials.

4. Performance & Results Disclaimer

While Peakora employs data-driven, evidence-based marketing protocols designed to maximize patient acquisition and ROI, we operate on third-party platforms (Google, Meta, etc.) whose algorithms change frequently.

  • No Guarantees: We do not guarantee specific rankings on search engines (e.g., a permanent #1 spot on Google), a specific number of new patients, or exact revenue figures.
  • Search engine algorithms, competitor activities, and market demand are beyond our control. Our commitment is to execute high-quality, industry-standard strategies to achieve the best possible outcomes.

5. Financial Terms & Billing

  • Payment Schedule: All digital marketing retainer services are billed in advance on a monthly basis. Web development and one-time projects require a designated upfront deposit before work commences, as outlined in your specific proposal.
  • Non-Refundable: Due to the customized nature of digital marketing and the immediate allocation of resources, all payments and fees are strictly non-refundable once work has commenced.
  • Ad Spend: For paid advertising campaigns (Google/Meta Ads), the “Ad Spend” budget is billed directly to your credit/debit card by the respective platforms. Peakora’s agency retainer fee is separate from the platform ad spend.

6. Intellectual Property Rights

  • Client Ownership: Upon full and final payment, you will own the final website design, domain name, and the content produced specifically for your practice. You will also retain ownership of your Google Ads and Meta Ads accounts.
  • Agency Ownership: Peakora retains ownership of our proprietary marketing methodologies, internal software, campaign structures, and custom code libraries used to deliver the services. You may not replicate, sell, or distribute our proprietary systems to third parties.

7. Term and Termination

  • Notice Period: Monthly marketing retainers require a 30-day written notice for cancellation. This ensures a smooth handover of assets and proper wrapping up of active ad campaigns.
  • Termination for Cause: Peakora reserves the right to terminate the agreement immediately if the Client engages in unethical medical practices, requests fraudulent marketing tactics, or fails to make payments within the agreed timeframe.

8. Confidentiality

Both parties agree to keep all proprietary information, business strategies, financial data, and patient acquisition metrics strictly confidential. Peakora will not disclose your internal practice data to your competitors.

9. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh.
